If a S.A.G. actor plays himself his "acting" is not governed by S.A.G. therefore he can do so in a non-union film correct?

If you can convince both the actor and SAG that the actor will not
be "acting" so is not covered by the Guild rules then it may work.
SAG does not have wording in their contract limiting "acting" - the
contract uses words like "appears". A person appears in a motion
picture. It's an interesting distinction but I suspect it won't work.
If your non union film is not a documentary or an interview; if it
has a script and the actor has lines or is encouraged to improvise
within a boundary of a story or scene then it falls under the SAG
definition of a motion picture.

I am certain that SAG would not agree in written or spoken form to such a thing. My question is would SAG penalize the actor. In a Non-Union film the production has no responsibility either morally or legally to SAG. No contract has been signed between SAG and the Producer. The big question is would SAG attempt to penalize the actor for his actions.

They might. So you should contact the actor to see if he is willing to
work non union. I don't think you can find a work around by claiming
the actor isn't "acting" so is not covered and free to work on a non
union show. But you can try it.
I think you best option is to contact the actor and see if you can work
out a deal.
