I have a general question concerning a copyright. I'm writing a script for a short film, and I want to use those Chick Tracts as a prop. I have a very low budget, so I emailed Chick Publications asking if they could donate a few tracts, even though theyre like $0.15 a piece. But they replied, saying that "Mr. Jack Chick does not allow his tracts to be used in other people's materials." Does this mean I cant use them, if I intend to submit the film to a festival? I'm going to include the tracts as props regardless. I want to submit this to a few film festivals, and I'll edit them out if needs be, but I was just wondering about the legality of this issue.

If the owner of the copyright doesn't allow you to use
their property that means you can't use them. The reason
you want to or need to use them doesn't matter. Jack Chick
is the owner. He decides who is property is used.

I'm sorry to hear you say that. But we each do what we
feel is right, don't we? If you are going to use the tracts
no matter what the owner says, why ask?

I am going to use them regardless, but I'll edit them out of the final version of the film that I'll submit to the festival. I cant get in any trouble for using them in a copy of my film that is for personal viewing. Like I said.

I would recreate a mock up version of a Chick like booklet. If need be cut up some old comic books staple them together and never reveal the booklet in its entirety. Don't forget not to call them "Chick Tracts". If your final version will work without the Chick sequence there is no reason it won't work with a partial reveal of the prop.

If you can't show it in a festival what is the point?

Create a similar but different prop. One that you can use. What is so special about Chick Trax anyway?
