I sort of asked this early, but now this is a more specific question and has the benefit of a recent trip today to the cemetery: Is there a problem legally having tombstones in a shot? At the cemetery today, I noticed the big vertical family marker tombstones (these are what I am concerned about) only have a last name, like SMITH or ANDERSON or JOHNSON, so I am thinking how could that be a problem if such a tombstone is in the shot-- I mean it is just a last name, no complete name, no dates of birth to death; the individual family member names that identify someone specifically are on small stones that lie flat with the grass and are not visible. Should I be OK if such vertical last name only family marker stones are visible?

Maybe someone else has a different answer, but the answer I have is exactly the same as the answer I gave you in the other thread. Each cemetery will have different rules. You may be right that it's just the last name and no one can identify it. If you are willing to take the chance and film the tombstone and have a problem come up later, then you can do it. There may be no problem at all. But if you are seriously interested in the actual, legal problems then you need to contact the owner of the cemetery.
Are you making a movie that you hope to sell and/or show in festivals? Or is this just something for your cast, crew, friends and family?

I don't see why that would be a problem but you should probably contact a legal advisor about it. That and as the other guy said, make sure to get permission from the cemetery.
When we shot in a cemetery, one of the conditions was that we weren't allowed to show the names on any tombstones.
